Employment Law Counseling and Human Resources Consulting
We take a proactive approach to counseling employers in an effort to avoid problems before they occur. Toward that end, we work with employers to ensure their compliance with wage and hour statutes, the FMLA, ADA, and COBRA. We draft personnel policies and employee handbooks, counsel managers on hiring and termination decisions, conduct pre-litigation investigations of suspected discrimination or harassment, and provide disparate impact studies to facilitate reductions in force. In fact, to obtain the most defensible position against litigation, many of our clients seek our advice before their human resources decisions are made.
We also regularly conduct training sessions for business owners, managers and/or rank and file employees on a wide variety of employment law topics. Specifically, we provide state-of-the-art training programs on topics such as sexual harassment, diversity and workplace discrimination, Union avoidance, and HIPAA compliance. Employment Litigation
We provide businesses and managers with cost-effective, aggressive representation in all types of litigated matters involving employees. For example, we have successfully defended against the array of claims that employees can assert: from race, disability, religious and pregnancy discrimination claims, to whistleblower, wrongful discharge, sex harassment, breach of contract and employment tort cases. Our employment litigation practice also includes the enforcement of noncompetition, anti-solicitation and confidentiality agreements, and the representation of employers before the Department of Labor in wage and hour matters, and before the EEOC and DCR on administrative charges.
Traditional Labor
In the area of traditional labor law, our attorneys represent employers in union organizing campaigns, collective bargaining, arbitration, strike and picket line issues, and NLRB proceedings.
