In a case of first impression involving a recently enacted state statute, Charles S. Lorber and Lance N. Olitt of the commercial Litigatin Department, obtained an order from the Essex County Superior Court, reversing a zoning board's denial of a developer's application to convert an approved age-restricted development to a non age-restricted development. The statute was enacted to address economic difficulties that developers are having in marketing age-restricted units, as well as the State’s need for more affordable housing. Provided a developer meets certain qualifications under the statute, which includes a requirement that no one has either purchased a unit or placed a deposit for a unit at the development, the statute allows the developer to file a conversion application with the land use board that approved the original age-restricted project. Where a conversion application is denied, the law gives the developer the right to a speedy appeal, in a summary proceeding filed in State Superior Court.

Stuart Gold, a partner in the Commercial Litigation Department, obtained summary judgment in his client's favor on an ERISA case pending in the District Court for the District of New Jersey. The issue, which was a matter of first impression in the Third Circuit, was whether, based on California's "Slayer Statute," or federal common law, a husband who had arranged for his wife's murder was ineligible to receive benefits under the wife's ERISA qualified retirement plan. The Court held that the benefits would go to the deceased wife's estate for the benefit of the couple's only child who was represented by the firm.

Thirty members of the Mandelbaum, Salsburg braved the rain and cold on October 24, 2009 to walk in the Annual West Orange Mayor’s Walk/Run to Break the Silence of Ovarian Cancer in memory of Rosalyn Steinberg, the late wife of retired Mandelbaum Salsburg partner, Richard Steinberg. Meanwhile, another 60 people led by Richard Steinberg took to the streets of Stuart, Florida for the annual American Cancer Society’s Walk For the Cure. Together the groups raised $7,000 to battle cancer research.

Craig W. Alexander, a partner in the firm’s Real Estate Department, secured the registration of an 81 unit mixed use condominium with the Department of Community Affairs, which will allow the developer to market and sell units in the building. The project, located at the former Shop Rite supermarket in South Orange, consists of 79 residential units, 2 commercial units and a 205 space parking deck. Craig previously represented the developer in assembling and acquiring the property as well as securing land use approvals to construct the project.

Phillip Ray, an associate in the Firm’s Labor and Employment Law Department, obtained summary judgment for its clients in a New Jersey Federal wrongful termination case. The plaintiff claimed that he was the victim of discrimination and that his Due Process rights were violated when he was terminated for failing an employer-mandated drug test. In an unpublished decision, the Court found nothing improper about the plaintiff’s termination.

On September 17, 2009, Mark Kluger, Chair of the Labor and Employment Law Department, gave a speech to the Greater Princeton Human Resources Association on “Effective and Litigation Friendly Performance Evaluations for Employees.” The speech was well attended with close to 50 human resources professionals in the audience.

After a six day bench trial in the Superior Court, Law Division, Sussex County, Richard Salsburg, co-chair of the firm’s commercial litigation department, obtained a favorable verdict of approximately $2.8 million for the firm’s client, the plaintiff in a breach of contract action. The court awarded plaintiff $1,775,698 in compensatory damages, together with liquidated damages of $650,000, interest and legal fees. Lance Olitt, an associate in the litigation department, assisted in the trial.

Joseph Discenza, head of the firm's Personal Injury Department, obtained a $350,000 settlement for a client who suffered a broken leg as a result of an accident at a transfer station.

In a unanimous decision issued on July 27, 2009, the Appellate Division of the New Jersey Superior Court affirmed an arbitration award of $3,754,512.06, now approximately $4.5 million with interest and fees, in favor of one of Mandelbaum Salsburg’s clients, Joseph A. Natoli Construction Corporation who was the general contractor on a shopping mall project owned by the defendant Watchung Square Associates, L.L.C. Partners Cheryl H. Burstein and Richard M. Salsburg tried the arbitration. Partner Arthur Grossman argued the appeal and Ms. Burstein and associate Christopher M. Erb prepared the successful appellate brief.
